6.                   Request TO RESCHEDULE the Public Hearing for vacation of old right of way at 22915 Greater Mack, PC 05-15 to August 15, 2005 Motion by Soulliere, seconded by McFadyen.  Approved 7-0

7.                   Request from Pat O’Brien’s Tavern for outdoor music on patio during the Venetian Fest events - August 12-14, 2005 Friday 6-11 pm , Sat.  2 – 11pm and Sunday 2 – 9 pm Motion by McFadyen, seconded by Soulliere.  Approved 7-0  

8.                   Request from Tree of Hope Foundation to be recognized by the City as a non-profit organization  Motion by McFadyen, seconded by Stahl.  Approved 6-0-1 Abstain: Moffitt

8.        Request for a 2 ft. variance for total height for a proposed home renovation at 22651 Lakeland,                 petitioner G. Puck (Rescheduled to 8/15/05 at petitioner request)

9.                   Request for variance to leave existing fence in lieu of a 6 ft. wall as required by Ordinance at 21618 9 Mile Road, petitioner G. Jayakar (rescheduled from 7/18/05) Motion by McFadyen, seconded by Soulliere to Deny Variance.  Approved 6-1 Nay: Stahl

11.                Request for 18 ft. front yard setback variance and a variance to allow an accessory building/structure in the front yard, to be used as office space at 30512 Jefferson, petitioner D. 14.                Request to approve sign in Central Lakefront District at 24125 Jefferson, Wilson Marines, petitioner Mid Michigan Neon Motion by McFadyen, seconded by Boyle to POSTPONE ITEM.  Approved 7-0

15.                Request for a variance to allow an accessory building in the side yard at 23416 Helen, petitioner L. Yepez Motion by McFadyen, seconded by Soulliere.  Approved 7-0

16.                Request for a variance to allow a pool in the side yard at 28005 Worthington, petitioner K. Kalisz Motion by McFadyen, seconded by Stahl to approve a pool in the side yard with privacy fence to abutting neighbor.  Approved 7-0

19.                City Manager’s Report Motion by Soulliere, seconded by McFadyen to adopt the Macomb County Law Enforcement Mutual Aid Agreement.  Approved 7-0

21.                Request to enter Closed Session as permitted by State Statute MCLA 15. 268, Section 8 (c) & 8 (e) J. Beck v St. Clair Shores  Motion by Soulliere, seconded by McFadyen to enter closed session at  9:18 pm.   Approved 7-0.  Motion by Soulliere, seconded by Walby  to re-enter open session at 10:07 pm.  Approved 7-0.  Motion by Soulliere, seconded by Stahl  to accept the recommendation of the City Attorney regarding J Beck v SCS.  Approved 7-0  Motion by Soulliere, seconded by Stahl  to adjourn the meeting at 10:09 pm.  Approved 7-0
