5.   Request from Nine-Mack Merchants’ Association to hold the Annual Nine-Mack Junefest on Saturday, June 7, 2008 from 10 am – 5 pm on Greater Mack from Nine Mile to Cavalier Drive closing this portion of Greater Mack for the Event at 5 am until 7 pm.  Motion by McFadyen, seconded by Ahearn.  Approved 7 – 0.

6.   Request to add Dance permit to Class C licensed business at 24935 Jefferson, Petitioner Tom’s Oyster Bar - Nautical Mile, Inc.  Motion by Frederick, seconded by McFadyen.  Approved 7 – 0.

7.   Request for Appeal of Water Resources & Advisory Board decision of Lake Case #10-2008 at 26830 Koerber, petitioner G. Grenadier.  Motion by Frederick, seconded by Rubello to DENY appeal.  Approved 7 – 0.

8.   Request to approve an amendment to the Open Burning Ordinance 40.300.  Motion by Ahearn, seconded by Moffitt.  Approved 7 – 0.

9.   Request to approve an amendment to the Board of Fence Arbitration Ordinance Section 22.202.  Motion by Ahearn, seconded by Moffitt. Approved 7 – 0.

10. Review of the 3rd Quarter Budget Report and approve budget amendments 08-06 & 08-07.  Motion by Walby, seconded by Frederick.  Approved 7 – 0.

12. Consent Agenda - Motion by Walby, seconded by Moffitt to approve items a – f.  Approved 7 – 0.

      f.    Request to accept Planning Commission's recommendation to distribute the 2008 Comprehensive Plan as required in Michigan Compiled Laws Public Act 285 of 1931, as amended. 

      g.   Recommendations from Council Sub-Committee on Boards, Commissions and Committees.  Motion by Moffitt, seconded by Ahearn to approve items 1-3.  Approved 7 – 0.

15. Request to enter closed session as permitted by State Statute MCLA 15.268, Sections 8 (c). Motion by McFadyen, seconded by Ahearn to enter Closed Session at 10:02 p.m. Approved 7 – 0.

Motion by McFadyen, seconded by Frederick to return to Open Session at 10:09 p.m. Approved 7– 0.

Motion by McFadyen, seconded by Frederick to hire Mr. Watza as the City Attorney for Cable and Cable Franchise matters.  Approved 7 – 0.

16. Adjournment.  Motion by McFadyen, seconded by Ahearn to adjourn at 10:10 p.m.  Approved 7 – 0.
