4.                   Comments by Individual Councilpersons Motion by Walby, seconded by McFadyen to suspend 2004 Sidewalk Replacement Program for 2 weeks.  Approved 6-1.  No:  Soulliere

5.                   Request from Lac Ste Claire Kiwanis Club to hold Kiwanis Harper Charity Cruise on August 25, 2004 from 5 – 9 pm. on Harper from California to Bon Heur Motion by Boyle, seconded by McFadyen.  Approved 7-0

6.                   Request for a variance of 6ft cement wall to erect a 6 ft wood fence for PC 04-08A for conversion of Church to professional office space 26333 Jefferson (former Christian Science Church) Motion to approve variance to install a 6 ft wood fence, rather than a 6 ft cement wall with the remainder to be cyclone fence by Soulliere, seconded by Stahl.  Approved 7-0. 

7.                   Public Hearing for Street Vacation  PC 04-06, southerly 120.74 ft. of Harmon Avenue, north of 9 Mile Road, 9 Mile Storage, at 20355 9 Mile Road, petitioner Anthony Ferlito Motion by Hison, seconded by Soulliere. Approved 5-2.  No:  McFadyen, Dumas

8.                   Request from LCC to adopt a resolution for a new Small Wine Maker License to be located at 24601 Jefferson, petitioner Red Hat Micro-Winery Company Motion by Soulliere, seconded by Walby.  Approved 7-0

9.                   Request for Site Plan approval PC Case 04-10 at 27801 Jefferson for proposed addition, interior renovations, and driveway/drop off area, at Lakeshore Presbyterian Church Motion by McFadyen, seconded by Hison.  Approved 7-0

10.                Request to approve transfer stock in 2003 Class C licensed business with Dance Permit located at 31100 Harper, (Shore Lanes) Motion by Soulliere, seconded by Hison.  Approved 7-0

11.                Request from P.B. Associates regarding proposed 36 unit, four-story, condominium development, Lakepointe Tower Phase II

a.       Request for Site Plan Approval PC #04-11, for a condominium complex, Lakepointe Phase II, at Country Club Drive Motion by McFadyen, seconded by Hison.  Approved 7-0

b.       Request for a sign variance to allow a temporary sign for one year in the road right of way in median of Masonic and Lakepointe entrance, petitioner PB Associates for the Links at Lakepointe Condominium development Motion by Hison, seconded by Soulliere.  Approved 7-0

12.                Award bid for the 11 Mile and Harper Water Main Replacement, bids opened 4/6/04 Motion by McFadyen, seconded by Hison.  Approved 7-0

13.                Adoption of Ordinance amendments to the Traffic & Vehicle Ordinance 21.400 regarding commercial vehicles parking in residential areas Motion by Hison, seconded by Soulliere.  Approved 7-0

14.                City Manager’s Report Motion by McFadyen, seconded by Hison to approve a Fuel Pumping and Security Card System for approximately $28,150.  Approved 7-0

15.                Delivery to Council of Proposed 2004/2005 budget

16.                Bills, Fees, and Progress Payments  Motion by Soulliere, seconded by Walby.  Approved 7-0

St. Clair Shores, Benchmark v St. Clair Shores and Teschendorf v St. Clair Shores  Motion by Soulliere, seconded by Walby to enter closed session at 9:55 pm.  Approved 7-0  Motion to return to open session by Soulliere, seconded by Walby.  Approved 7-0  Motion by Soulliere, seconded by Walby to accept recommendation of City Attorney.  Approved 7-0
